Offensive Content

You may not publish, transmit, or upload via or to Hostlumina’s service any content (including Web content, e-mail, bulletin board postings, blogs, chat, and any other type of posting or transmission that relies on any Internet service provided by Hostlumina) that Hostlumina reasonably believes:

  • Contains expressions of hate, abuse, offensive images or conduct, obscenity, pornography, or sexually explicit material.

  • Could give rise to any civil or criminal liability

  • Is excessively violent, incites violence, threatens violence, or contains harassing content or hate speech;

  • Is unfair or deceptive under the consumer protection laws of any jurisdiction, including chain letters and pyramid schemes;

  • Infringes or assists others on infringing on the intellectual property rights of others or on the privacy or publicity rights of others;

  • Creates a risk to a person’s safety or health, creates a risk to public safety or health, compromises national security, or interferes with a investigation by law enforcement;

  • Improperly exposes trade secrets or other confidential or proprietary information of another person;

  • Violates or promotes violation of local, state, national, or international laws, including those regarding drugs, export control, gambling, or arms trafficking;

  • Is otherwise illegal or solicits conduct that is illegal under laws applicable to you or to Hostlumina; or

  • Is otherwise malicious, fraudulent, or may result in retaliation against Hostlumina by offended viewers.; or

  • Restricts or inhibits any other person from using or enjoying Hostlumina’s service or website, or which, in the judgment of Hostlumina, exposes Hostlumina or any of its customers or suppliers to any liability or detriment of any type.

Security

You must take reasonable security precautions. You must protect the confidentiality of your password, and you should change your password periodically. Clients are required and obligated to maintain all security on their servers. Any and all additional charges that are incurred due to client lack of monitoring or security are the responsibility of the client.

IP Addresses

Clients retain no ownership rights to any IP addresses issued. Clients may not transfer IPs. Any client purchasing over 16 IP addressed in addition may be required to submit ARIN justification forms as well as submit to additional terms depending on the number of IP addresses desired. Scripts/Programs

It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 644 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as username and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.

Zero Tolerance Spam

We take a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. "Safe lists" and "double opt-in" will be treated as spam. Any user who sends out spam will have their account terminated with or without notice.

Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.

Hostlumina reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.

Hostlumina reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee. This cost of the clean up fee is entirely at the discretion of Hostlumina.

If your actions have caused any IP addresses of any of Hostlumina's servers to be placed on any blacklists or any other email filtering software systems, a $90 charge will be added to your account in addition to $90 per hour beyond the first hour for administrative charges incurred to remove and protect our servers and IP addresses from any blacklists or other email filtering software systems.

Sabotage

Any type of sabotage, regardless of intention, shall be grounds for termination of an account. This includes but is not limited to abuse of the remote reboot system by using it multiple times in a very short amount of time for improper reasons.

Email Limits

There is a 200 hourly email limit per domain this limit is also applied towards mailman. If you send over this amount in any hour most of the emails will bounce back with an undeliverable error.

Mailing Lists Rules

Anytime you're sending a message no matter how large your e-mail list is you must throttle it. We recommend you throttle it to at the very least sending 1 email every 6 seconds. If the mailing list software you're using does not allow you to throttle you must switch to something else. We recommend phplist which can be found in your control panel under fantastico. If you do not throttle and you try sending let's say 200 emails the server will try sending all 200 in 1 second which is not possible. This will cause the server load to go very high and for the entire server to be sluggish until this process is completed. It is our job to keep the server up and running without being sluggish. Anyone who causes the servers load to go high will be suspended and the process will be terminated. Failure to throttle you will most likely be suspended for crashing the server.

Any mailing list over 900 emails is only allowed to be sent to during off-peak times to prevent high server loads. Off peak times qualify as all day Saturday and Sunday, and 1am - 8 am eastern time M-F.

You are not allowed to mail to a mailing list you were given or purchased. This is spamming because they never agreed to you personally sending them mail. This is spam and will result in termination of the offending account.

No Direct SMTP mailers are allowed. An example of this is DarkMailer. Any mail should be relayed through the local MTA (localhost:25) for further delivery by the server and not done directly by scripts

Unsolicited E-Mail

You may not send any unsolicited e-mail, either in bulk or individually, to any person who has indicated that they do not wish to receive it.

You must comply with the rules of any other network you access or participate in using your Hostlumina’s services.

Material Protected by Copyright

You may not publish, distribute, or otherwise copy in any manner any music, software, art, or other work protected by copyright law unless:

you have been expressly authorized by the owner of the copyright for the work to copy the work in that manner;

you are otherwise permitted by established United States copyright law to copy the work in that manner.

Hostlumina will terminate the service of repeat copyright infringers.

Other

You must have valid and current information on file with your domain name registrar for any domain hosted on the Hostlumina network.

Disclaimer

Hostlumina is under no duty, and does not by this AUP undertake a duty, to monitor or police our customers’ activities and disclaims any responsibility for any misuse of the Hostlumina network.

Internet Abuse

You may not engage in illegal, abusive, or irresponsible behavior, including:

Unauthorized access to or use of data, systems or networks, including any attempt to probe, scan or test the vulnerability of a system or network or to breach security or authentication measures (including those belonging to Hostlumina and its customers) without express authorization of the owner of the system or network;

monitoring data or traffic on any network or system without the authorization of the owner of the system or network;

Interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks;

Use of an Internet account or computer without the owner’s authorization, including, but not limited to Internet scanning (tricking other people into releasing their passwords), password robbery, security hole scanning, and port scanning;

Forging of any TCP-IP packet header or any part of the header information in an e-mail or a newsgroup posting; or

Any conduct that is likely to result in retaliation against the Hostlumina’s network.

Use of Hostlumina’s network in a way that unreasonably interferes with Hostlumina’s other customers use of the network

Newsgroup, Chat Forums, Other Networks

You must comply with the rules and conventions for postings to any bulletin board, chat group or other forum in which you participate, such as IRC and USENET groups including their rules for content and commercial postings. These groups usually prohibit the posting of off-topic commercial messages, or mass postings to multiple forums.
